On Jan. 9, a three count indictment was filed against Clyde Napier. The indictment charged count one, Illegal Assembly or Possession of Chemicals for the Manufacture of Drugs, a Felony of the Third Degree, having a maximum penalty of 36 months in prison, a $10,000.00 fine and an operator license suspension between six months and three years, count two, Aggravated Possession of Drugs, and count three, Theft, both felonies of the Fifth Degree, having a maximum penalty of 12 months in prison and a $2500.00 fine. On June 4, 2015 Defendant entered a plea of guilty to Count One before Brown County Common Pleas Judge Scott T. Gusweiler.

On that same date Judge Gusweiler sentenced Napier to 30 months in the Ohio Department of Corrections, to be served concurrently with the sentence imposed in Highland County Common Pleas Court, an operator license suspension of 12 months with a dismissal of counts two and three. Judge Gusweiler further advised the defendant of an optional three years of Post Release Control through the Adult Parole Authority upon his release from prison.
